There are a number of laws which might apply, and none of them are federal, so the details will vary depending on where you live. First of all, if the student is underage, it is considered statutory rape for an adult to be sexually involved with a student. That pretty much is the major approach used to prosecute middle and high school teachers.
Secondly, it is generally considered sexual harassment, because the relationship cannot be equal between a teacher and a student. The student just doesn't have a choice. You will usually find that unless the student is a minor, the teacher only gets into legal trouble if the student her/himself complains.
In addition to those legal aspects, most schools have their own policies on dating between students and teachers. They are trying to do two things. First, they need to protect students from predatory teachers (the type who will threaten to fail a student unless s/he sleeps with the teacher). Secondly, they need to maintain an environment which is comfortable for all students. The teacher who has 100 students in class and has a relationship with one of them is giving an unfair advantage to some students over others. Having gone through this as a college freshman with a male professor who was sexually involved with several of the women in class, it was the men who felt most resentful, because there was nothing they could do to get the type of attention from the professor that the women got (not to mention that some of the women he slept with were their girlfriends!). Overall, it creates a lot of messy situations which may be viewed differently by one party than by another, and should be avoided.What is the law on student and teacher relationships?
Ok, I understand the underage laws and all, but I'm confused about something. What if the student in of age, like on a college level, and is not in that teacher's class? What if the student just so happens to go to the university where that professor teaches?

Provided that the pupil is over the age of consent there is no law to prevent pupil/teacher relationships.
Most schools and colleges include, in their terms and conditions of employment of teachers, that having a relationship with a pupil is a dismissible breach of contract. The teacher in such a case would lose his/her job, and would render him/herself unemployable as a teacher in the future.
The ';why'; is that such relationships are seen as breaches of trust. Teachers are employed to teach, not enjoy relationships with students.
It depends on where you are and how old you are. In Britain, a sexual relationship between a teacher and a student under 18 is illegal, as it's classed as a ';breach of trust'; offence. Above that, it's legal, but there's a good chance it will result in the teacher losing his job and having a seriously hard time finding a new one!
The reason for this harshness is that students and pupils are classed as ';vulnerable';, and there is a tradition of students falling for ';Sir'; or ';Ma'am'; for reasons relating to the percieved power, knowledge and ';coolness'; of their job.
It is illegal. The teacher is in a position of trust and has a responsiblity to look after the children in their care - not seduce them! Even if the pupil is over 16 it is illegal. If a student has left school at 18 and the teacher no longer tutors them then I believe it is not illegal in the eyes of the law, but morally is frowned upon. Besides, dont you think it is a little sick? A grown adult grooming a child in their care? I know children do have crushes on their teachers but it is the adults duty to deflect this attention.
first off ,it is very unethical and can get that particular teacher fired and possibly sued...also a teacher is supposed to be an authortiy figure to the student and also a role model ,and to do anything like that would be unethical and prove that that teacher has no concern for ethics...

The laws pertain to age limits for sexual contact. Break that law, the teacher goes to jail.
In addition, even if the student was over 18 and no law was broken, each school has their own code of conduct for both students and faculty. This would usually result in the teacher being fired and the student being suspended or even expelled.
I hope for everyone's sake that this is a theoretical enquiry! If anyone is below the legal age of consent then a sexual assault has occurred, if a pupil is harassing a teacher then they can be cautioned/convicted (depending on their age) Even in a situation where the pupil is of an age to give consent then the teacher has committed a breach of trust and this will affect their career negatively,what happens specifically will depend on the school. The rules are there for good reasons!
The teacher would be taking advantage of a minor under his/her authority--a despicable thing to do, and thus frowned upon. Your location may have specific laws against it; if not, it probably would be statuatory rape, if the student is under the age of consent.
Well if they're a minor I believe it's illegal. I'm not so sure about in university etc. but it's still frowned upon. It's because the teacher is in a position of authority (and no doubt quite a bit older than the student), and so it's easy for them to take advantage of a student.
School or university?
In schools it's illegal and even after the pupil has left school it's still illegal to have a relationship with a former pupil. (forget the time span)
At college and university it's an internal matter. Usually overlooked because that's how many students get good grades.
If the student is a minor, it is illegal.
If the student is an adult, the school sets the policy.
I'm not sure IF there is a law, but it will of course affect the teachers judgement of your work, it is not a good idea.
If the student is underage, there certainly are many child abuse laws, statutory rape laws, etc.

I would think its illegal but having said that i had sex with two of my P.E. teachers while at secondary school, it was a fantasy thing for me and the first teacher was very good looking, i wouldn't have a shower so he waited till the other boys had gone and got in the showers himself then ordered me in, only 14 years but i enjoyed it.
