I understand the law about if the student is underage that is statutory rape, but I've always wondered about students on a university level. What if the student is not in the professor's class? What if they just so happened to meet where at the university and the college student it of age? What is the law on student teacher relationships if the student is of age?
With students of sixth form age, it is not legal for a teacher to have sexual relations with a student, even when the student is over 16.
At university level, there is no legal problem, although some universities have codes of practice, especially where the teacher is assessing the student's work. What is the law on student teacher relationships if the student is of age?
If this was in the UK, the relationship would be legal, so long as the student and teacher were not in the same school, college or university.
If the student is in that teacher's class, or under his or her authority in any way, then it remains illegal. It is not just a sexual matter in law, but one of abusing or exploiting a position of trust or authority.
Don't forget the problems it creates for other students in the form of allegations of favouritism etc.
The following website gives guidance to local government staff, including teachers, on how to comply with the law, and avoid abusing the trust we place in them.
Teachers do get prosecuted for having relationships with their legally mature students, though some teachers think this law is wrong (BBC article below) - wrong or not, it IS the law.
Because of the fiduciary relationship, the fact that the teacher is involved in someway with the grading/marking/teaching at the uni then it could not be a good idea. Due to allegations of 'grades for sex' or any kind of bribery or blackmail for either the student or the teacher it obv would not be allowed to go on, if not in the courts then the university would have to dismiss the teacher. Or risk massive scandal and ruin the unis reputation if it ever got out.
Legally, there is no bar on such relationships.
However, it is often a disciplinary offence for the university professor, and can result in him/her being fired for misconduct.
Legally, no problem. Although the school might take a dim view of it.
Flapping well go for it.
